These Terms and Conditions constitute a legally binding agreement between the end user ("You") and Remaply ("the Platform"), governing the access and use of all Remaply services, websites, apps, and software modules (collectively "the Service"). Use of the Service signifies that you have read, understood, and consented to be bound by the detailed provisions herein, regardless of comprehension or review in full. Please read them carefully continued use implies acceptance of all present and future clauses, including those that may be appended at our sole discretion without prior individual notification.
  1. Introduction Welcome to Remaply, an interactive geospatial address mapping platform designed to facilitate the identification, standardization, and virtual registration of individual locations through user-generated digital codes. Access to Remaply constitutes acceptance of a multi-layered framework of conditions, which you are legally and contractually bound to adhere to, whether or not you engage with all modules or features. The Remaply system integrates real-time geographic input, encoded geohash infrastructure, and programmatic location claims into a singular unified user interface. By engaging with Remaply in any capacity including browsing, account creation, location claiming, API interaction, or third-party integration you unconditionally agree to the procedural terms, binding responsibilities, enforcement measures, and regulatory disclaimers that follow, including any annexes or referenced sub-policies. designed to help users generate and manage virtual postcodes, improve service delivery, and enhance personal safety through geolocation. By accessing or using Remaply, you agree to be bound by the terms and conditions outlined below.
  1. Definitions • "Remaply" refers to the web and mobile applications, services, and systems provided under the Remaply brand. • "User" refers to any individual or entity accessing or using Remaply. • "Virtual Address" refers to the geospatially mapped digital postcode assigned to a location. • "Emergency Integration" refers to any functionality designed to interface with first responders or warning systems.
  1. Eligibility You must have reached the legal age of digital majority as defined by your country of residence, which in no case shall be less than 13 years of chronological age. By creating an account or otherwise accessing the Service, you represent and warrant that you meet this eligibility requirement and possess the full legal and cognitive capacity to enter into binding contracts. In jurisdictions requiring additional oversight for minor engagement, a legal guardian's express authorization is required. Verification of such eligibility may be requested and enforced through identity confirmation mechanisms, automated filters, or periodic user audits at the discretion of the platform administrator. Failure to meet eligibility requirements, or the presentation of falsified credentials or misrepresented data, shall constitute an immediate breach of these Terms and may result in suspension, deletion, or legal escalation without further notice or opportunity for remediation. and legally capable of entering into contracts to use Remaply.   1. Account Responsibilities Users are required to provide complete, accurate, and current personal and technical details when creating and maintaining a Remaply account. This includes, but is not limited to, name, email address, contact details, and device information. Failure to do so may result in degraded service quality or enforcement action. You are solely and unequivocally responsible for maintaining the confidentiality, integrity, and access control of your account credentials. Any unauthorized access resulting from your failure to secure such information including password reuse, non-unique identifiers, or session hijacking will be attributed to you, and any resulting consequences (financial, legal, reputational) shall be borne in full. Users agree not to share their accounts, impersonate others, or allow proxy access. In the event of suspected compromise, users must immediately notify Remaply through an official support channel. Activity logs, access metadata, and usage patterns may be used to verify unauthorized access claims and, where appropriate, enforced under legal mechanisms for abuse. You are responsible for maintaining the confidentiality of your account and agree to accept responsibility for all activities that occur under your account.
  1. Permitted Uses Remaply is not a government-certified address registry, nor is it a substitute for official documentation used in postal delivery, national identity systems, voter registration, land claims, or legal residence determination. Any use of a Remaply-generated postcode or location profile in such contexts is entirely at the user's own discretion and risk, and Remaply disclaims liability for any outcome arising from such use. You agree to utilize Remaply exclusively within the scope of activities expressly sanctioned by this agreement and further delineated by operational guidelines, including: • The digital acquisition, verification, and management of your virtual geospatial address. • The receipt of location-based information streams, including but not limited to proximity alerts, civic mapping layers, and system-generated geofence updates. • The voluntary transmission of your current or fixed location to predefined recipients or emergency services. • Participating in structured programs to improve address quality, accuracy, and completeness across unclaimed or poorly indexed regions. • Enabling integration with gig economy platforms by offering verified geolocation endpoints for delivery, mobile services, or crowdsourced infrastructure reporting. • Supporting eCommerce optimization by providing standardized, searchable postcode metadata for regional inventory targeting, estimated time of arrival (ETA) mapping, and micro-logistics. • Interfacing with payment platforms, including Stripe or localized Pacific fintech providers, to enable address-based identity verification, fraud prevention, and dynamic checkout flows. You further acknowledge and agree to refrain from: • Utilizing the platform for activities deemed unlawful under any applicable legal framework. • Submitting or manipulating address claims that misrepresent physical locations or geospatial truth. • Posing as another individual, fictitious entity, or non-human automated system for purposes of abuse, misinformation, or exploitation. • Attempting to decompile, reverse-engineer, extract underlying datasets, or otherwise tamper with any of Remaply's source systems or APIs. • Distributing software, payloads, or URLs intended to disrupt, surveil, or degrade the integrity of Remaply or its user base. • Receiving geographic information or warnings. • Sharing your location voluntarily. • Participating in community address mapping. You agree NOT to: • Use the platform for illegal activities. • Falsify your location or claim fictitious addresses. • Impersonate another user or organization. • Scrape, copy, or reverse-engineer the service. • Transmit viruses, malware, or attempt to disrupt service.
  1. Emergency Features Remaply includes a set of safety and emergency functionality features that users may activate at their discretion, provided they understand that these services are offered on a best-effort basis with no guaranteed outcome. Such features include, but are not limited to: • Real-time geolocation sharing with designated contacts or emergency responders, transmitted via encrypted channels through short-lived tokens. • Receipt of disaster-related alerts based on address proximity, historic hazard zones, or dynamic threat models derived from third-party feeds. • Preconfigured address activation markers that may trigger silent notifications to authorities in the event of user distress. These features are opt-in only and rely on third-party partnerships with governmental or non-governmental response agencies. Remaply disclaims any responsibility for failure of notification, delay in delivery, non-engagement of third-party responders, or outcomes resulting from unactioned alerts. Users are advised to continue reliance on traditional emergency mechanisms and are expressly forbidden from using Remaply emergency modules as a substitute for official medical, law enforcement, or disaster response protocols. or Emergency Services Integration are provided on an opt-in basis. These tools may be subject to government partnerships or phased rollouts. Use of these features does not constitute a guarantee of emergency assistance.
  1. Intellectual Property All elements constituting the Remaply platform including, but not limited to, its user interface design, visual hierarchy, software architecture, underlying source code, algorithmic logic, data models, proprietary datasets, and derived content are considered the intellectual property of Remaply or its licensors and are protected by applicable copyright statutes, international treaties, trade secret conventions, and trademark registrations. Users may not duplicate, adapt, mirror, index, scrape, aggregate, disseminate, or otherwise extract elements of the Remaply platform without prior express written authorization. Any attempt to bypass protective measures, exploit undocumented endpoints, or simulate UI components for commercial use will be considered a direct infringement and subject to prosecution, takedown orders, or compensatory remedy, including injunctive relief. By uploading content, users grant Remaply a royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, and distribute said content within the platform’s scope, provided such use adheres to our privacy policy and community guidelines. You may not reproduce or republish any part without explicit written permission.
  1. Availability and Modification Remaply is a continuously evolving platform operating in a distributed environment that may be subject to scheduled maintenance windows, emergent patches, force majeure events, or performance degradation from dependent services. We make no representation as to uninterrupted access, flawless uptime, or cross-device consistency. We reserve the right, at our sole discretion and without prior notice, to modify, suspend, limit, or permanently disable portions of the platform or its affiliated services. Such modifications may include interface updates, algorithmic behavior adjustments, throttling, feature retirement, and geographic service scope changes. By continuing to use the platform, users accept that availability is conditional upon dynamic system parameters, third-party availability (e.g., maps, APIs), regulatory shifts, or infrastructural re-architecture, and waive any right to restitution or expectation of continuity. We may modify, suspend, or discontinue the platform or certain features at our sole discretion, with or without notice.
  1. Termination We reserve the right to suspend or terminate any account that: • Violates these Terms. • Abuses features (e.g., emergency modules). • Engages in fraudulent or unlawful activity.
  1. Disclaimer, Limitation of Liability, and Force Majeure Remaply is provided “as-is” and “as available.” We make no warranties as to accuracy, security, or fitness for a particular purpose. Under no circumstances will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with your use of the platform, regardless of the form of action or theory of liability, whether in contract, tort, strict liability, negligence, or otherwise even if we have been advised of the possibility of such damages. Furthermore, Remaply shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, governmental actions, war, terrorism, civil disturbances, labor shortages or disputes, internet or telecommunications failures, third-party service disruptions, natural disasters, pandemics, or other force majeure events.

Governing Law These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the user is physically or permanently located at the time of registration or use of the Service. This includes, but is not limited to, jurisdictions within the Pacific Island nations such as Fiji, Samoa, Tonga, Papua New Guinea, Solomon Islands, and Vanuatu. Remaply is operated as a foreign digital information service provider and does not maintain permanent legal or corporate establishment in any of the jurisdictions it serves unless explicitly declared. The platform is not designed to substitute or interfere with local addressing authorities, regulatory bodies, or emergency protocols unless officially integrated by local government agreement. Remaply expressly disclaims that its services are certified or compliant under any one jurisdiction’s national address or privacy laws unless specified. Users are solely responsible for determining whether their use of Remaply complies with local legislation, customary land boundaries, or national digital infrastructure regulations. In the event of a dispute, the parties agree to submit to the non-exclusive jurisdiction of the competent courts in the user’s respective country or territory, while also reserving the right to bring proceedings in any other competent jurisdiction where Remaply operates or maintains a legal presence. The application of international treaties, data protection directives, and consumer protection laws relevant to the user’s jurisdiction shall also apply where enforceable. Appendix B: Regional Data Infrastructure Disclosures Remaply reserves the right to migrate, mirror, or geographically distribute its infrastructure across alternative compliant jurisdictions in response to evolving data residency laws, business continuity risks, or performance optimization needs. This flexibility ensures uninterrupted service delivery in regions where legal frameworks, political instability, or physical infrastructure may impact continuity. • Primary Data Storage: All personal and location data is stored on Google Cloud infrastructure located in Australia and governed by the Australian Privacy Principles (APPs). • Operational Dependencies: Certain Remaply services, including edge delivery (via Vercel), push messaging (via Firebase), and analytics (via Apple/Google SDKs), depend on services hosted in the United States. • Security Measures: All cross-border data flows are encrypted (TLS 1.3+), tokenized where applicable, and subject to audit logging. We ensure minimum viable disclosure and user consent alignment. • Data Residency Commitment: Where feasible, Remaply ensures preference for data storage in the Pacific region and Australia and will continue to advocate for regional infrastructure investment in the digital economy. • Must accommodate government infrastructure initiatives. Disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Fiji.
  1. Third-Party Services Disclaimer Remaply integrates with a range of third-party platforms, including payment processors (e.g., Stripe), cloud infrastructure providers (e.g., Google Cloud, Vercel), and mobile app ecosystems (e.g., Apple App Store, Google Play). Your use of these integrated features is also subject to the respective terms, privacy policies, and data handling practices of these third-party providers. Remaply makes no warranty regarding and assumes no liability for the services, content, or practices of any third party.
  1. User-Generated Content and Community Conduct Users are solely responsible for the content they submit or publish through the platform, including address descriptions, location claims, and shared media. By uploading such content, you affirm that you have all necessary rights and licenses. Remaply reserves the right to remove, restrict, or moderate content that violates platform guidelines, intellectual property rights, or legal provisions. We enforce a zero-tolerance policy for abuse, harassment, misrepresentation, or coordinated misinformation campaigns. Accounts engaging in such behavior may be suspended or permanently removed without notice.
  1. Dispute Resolution Process Before initiating any formal legal proceeding, users agree to attempt to resolve disputes with Remaply through good-faith negotiation. If resolution cannot be reached within 30 days, either party may proceed with legal action as defined under the governing law clause.
  1. Accessibility and Inclusivity Remaply is committed to providing services that are accessible across a range of connectivity environments, languages, and device types common in the Pacific region. Where feasible, the platform incorporates low-bandwidth options, simplified UI pathways, and regionally relevant language support to ensure fair access and usability.
  1. Change Notification Protocol Remaply may revise these Terms and Conditions at any time. Material changes will be communicated via in-app banner or registered email (if available) at least 14 calendar days prior to the effective date of change. Continued use of the platform after this date constitutes acceptance.
  1. Law Enforcement Requests Remaply does not voluntarily share user data with law enforcement or regulatory authorities unless legally compelled. All requests for user information are reviewed for jurisdictional validity, legal sufficiency, and international enforceability. Requests must be accompanied by a lawful order issued by a competent authority in a recognized jurisdiction.
  1. Indemnification You agree to indemnify, defend, and hold harmless Remaply, its officers, directors, employees, contractors, affiliates, licensors, and service providers from and against all claims, losses, liabilities, damages, penalties, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Service, violation of these Terms, infringement of any intellectual property or other right of any person or entity, or breach of any representation or warranty made herein.
  1. Severability and Waiver If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall remain in full force and effect. No waiver by either party of any breach or default under these Terms shall be deemed to be a waiver of any preceding or subsequent breach or default.
  1. Beta Features and Experimental Modules Certain portions of the platform may be labeled as “beta,” “experimental,” or “preview” features. These features are offered on an “as-is” and “as-available” basis, may contain bugs or errors, and may be modified, suspended, or discontinued at any time without prior notice. No guarantees or service levels are provided for such modules.
  1. Data Retention Policy Remaply retains user-generated data for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Upon verified account deletion, personal data is flagged for removal across active systems. Anonymized, non-personal data related to address activity may be retained for statistical modeling, geographic optimization, and service diagnostics. Emergency access logs are anonymized 90 days after generation.
